I. General provisions

  1. F.H.U. PAFEN PIOTR HAMADA, ul. Luksemburg 14, 66-620 Gubin, NIP: 926-148-23-04, REGON: 978118135, entered into the register of entrepreneurs of CEIDG.
  2. Contact with the Internet Shop is possible via e-mail: sklep@pafen.pl or by phone: 604155416, fax: 68 455-40-44.
  3. The Regulations define the rights and obligations of the Customers as well as the rights and obligations of the Seller as the entity managing and running the Shop.
  4. The Terms and Conditions are available in English.
  5. Customers are obliged to observe the copyrights and rights resulting from the registration of inventions, patents, trademarks, utility models and industrial designs.
  6. The owner of www.pafen.pl is committed to secure processing of personal data of shoppers only in order to reliably perform the contract of sale concluded at a distance. Privacy Policy, is made available during the time of placing an order and sent each time in an e-mail with confirmation of the order.
  7. Exclusions of the right of withdrawal. According to Article 38 of the Act on Consumer Rights, the right to withdraw from the contract concluded at a distance or off-premises, according to the Act, the consumer does not have the right to withdraw, inter alia, in cases:
    • which has as its object an unprocessed item, manufactured to the consumer's specifications or intended to meet his individual needs;

 

II. Definitions

The terms used in the Regulations mean respectively:

  1. Shop – an online shop operating at www.pafen.pl, selling products in its offer.
  2. Owner – F.H.U PAFEN PIOTR HAMADA, ul. Luksemburg 14, 66-620 Gubin, NIP: 926-148-23-04, REGON: 978118135.
  3. Customer – any entity making a purchase in the Shop in accordance with the provisions of these Regulations.
  4. Customer account – a field containing data on transactions carried out and an instrument used to execute orders placed by the Client.
  5. Consumer - a natural person who performs a legal transaction with an entrepreneur not directly related to his/her economic or professional activity.
  6. Entrepreneur – a natural person, a legal person or an unincorporated entity, which carries out a legal transaction in its own name in the course of its business or profession.
  7. Working days – weekdays from Monday to Friday, except public holidays.
  8. Regulations – This document sets out the terms and conditions of using and purchasing products from the Store.

 

III. Technical terms and conditions of using the Store

  1. In order to use the Store, the Customer must have one:
    • a device for transmitting teleinformatic data;
    • access to the Internet;
    • email address.
  2. The shop collects information contained in cookies, which are text files. These files do not store any personal data, are used in an anonymous way to evaluate the real interest in the service on the shop pages. Cookies are used to exchange information between the Shop and the User, which greatly facilitates the adjustment of the offer to the expectations and preferences of each Shop User. The Customer decides on the use of cookies. Internet browsers are often set by default to install these files on the Customer's terminal device, which can change the settings at any time.
  3. The Shop informs that the exclusion by the Customer of the possibility of using the Cookies file may affect the functionality available in the Shop.
  4. Detailed information about the Cookies is contained in the Cookie File Policy, available at www.pafen.pl and constitutes an integral part of these terms and conditions.

 

IV. Registration and Login

  1. In order to set up a "Customer Account", the customer registers by entering his or her e-mail address, password and personal data using a form.
  2. The password entered when logging in to the Store may consist of letters, numbers and/or special characters. The password is individual for each user. The password can be changed on the website by entering an e-mail address and a new password. The creation of a customer account is free of charge.
  3. Registration is a condition for placing an order in the Shop.
  4. The customer undertakes to provide true information.
  5. By accepting the regulations, the Client declares the following:
    • I voluntarily joined to use the services of the shop;
    • the data contained in the form are accurate.
  6. The Customer may not transfer the password to the account in the Online Shop to third parties.
  7. A registered customer has the possibility:
    • access to the status and history of the zamacute;
    • receive individual discounts and promotional coupons;
    • information about the possibility of participating in promotions and competitions;
    • The product's coatings are in place,
    • changes in your data;
    • change your password;
    • ...to check your own pockets.
  8. After registration, the customer will receive a confirmation link to the e-mail address provided.
  9. The registration process enables you to log in to the system.
  10. The customer may not copy, modify or distribute the content, images, logotype without the prior consent of the authorized person.

 

V. Execution of orders

  1. The store is open 24 hours a day, 7 days a week, allowing the customer to place an order at any time, except for maintenance breaks. The customer also has the opportunity to place the order in person at the customer's premises during opening hours.
  2. The Online Shop confirms receipt of the order by an automatically generated e-mail message which it sends to the Buyer. The message contains the proposed content of the contract of sale, in particular: the number and date of the order, details of the purchased goods, price and payment method, details of the parties, place, method and cost of delivery.
  3. If the proposed content of the contract of sale is not in accordance with the order submitted by the Buyer, the Buyer shall notify the Online Shop thereof without undue delay by sending an e-mail indicating the discrepancies noted. The Online Shop shall without undue delay send the Buyer the corrected content of the proposed agreement.
  4. The Online Shop confirms the acceptance of the order for implementation by sending the Buyer another e-mail message. Upon receipt of this message by the Buyer, a contract of sale shall be concluded.
  5. The warranty card of the manufacturer, importer or distributor &ndash is attached to the goods sold; if the manufacturer, importer or distributor grants the warranty on the basis of a written warranty card.
  6. In the case of physical injury, customers may only be persons with full legal capacity.
  7. The customer shall place an order in the following manner:
    • This is done by adding them to your shopping cart;
    • Entering data to the registration or logging form, delivery form;
    • Delivery and payment methods;
    • Approval of the order via the order button with the obligation to pay;
    • Send confirmation of the order to the Customer's e-mail address;
    • An order placed in electronic form will be confirmed no later than within two working days (excluding holidays) after receipt of the order. Confirmation will be sent by e-mail or telephone.
  8. Registered customers can track the status of their orders.
  9. The customer undertakes to provide true information.
  10. The confirmation of the order placement sent to the Customer includes:
    • Store data, including the exact mailing address, e-mail address and telephone number;
    • description of the product;
    • the unit price and the total price of all products;
    • Order price = total price of the product + costs of contract execution (including payments and deliveries);
    • form of delivery, including the date of delivery and if there are any restrictions on delivery, e.g. weight or location;
    • How to pay for it;
    • information about the right to withdraw from the contract without giving any reason within 14 days;
    • information about the right to a warranty;
    • in the Annex, the model withdrawal from the contract shall be sent within 14 days.
  11. The shop allows for personal collection in the company's headquarters.

 

VI. Form of payment

  1. The customer has the opportunity to pay for the goods by way of a complex order in a form:
    • bank transfer;
    • cash on delivery;
    • payment via the PayPal payment system.
  2. The user is obliged to provide true data for the VAT invoice.

 

VII. Prices

  1. Prices given next to the products on the Store's website are in PLN and include taxes and fees. The price of the product before clicking the "Add to basket" button does not include shipping and other additional charges. Shipping and payment costs are added to the total amount of ordered products. Before placing an order, the customer is informed of any additional costs, e.g. packaging costs.
  2. The final price of the order, binding on the Store and the Customer, is the price of the product as stated on the Store's website before the order is placed by the Customer, including all costs associated with the performance of the contract.
  3. Information about the total value of the order (including shipping costs, payment) is made available before choosing the option "Order"; transaction with the obligation to pay; and is confirmed by an email sent immediately to the address provided by the customer.

 

VIII. Supply

  1. The Customer selects the type of delivery available on the Store's website, these are:
    • FedEx courier
    • DHL courier;
    • Personal collection.
  2. The delivery period is up to 30 days unless the delivery period has been individually agreed upon. If the delivery date is exceeded in accordance with the preceding sentence, the consumer has the right to appoint an additional period of time for the seller. If the goods are still not released, the buyer may withdraw from the contract.
  3. Deliveries are made on working days from Monday to Friday. Deliveries are not made on weekends or public holidays.
  4. The seller shall be liable for the risk of accidental loss of or damage to the goods until the consumer has received them, unless the consumer has chosen a different delivery method from that offered by the shop.
  5. The purchaser has the opportunity to inspect the goods at the time of receipt of the consignment and to make a record in the presence of the supplier in the event of any damage. Writing up a protocol is not a condition for lodging a complaint or exercising the right to withdraw from the contract.
  6. Goods are delivered in Poland and other countries of the European Union.

 

IX. Right of withdrawal

This section applies to you when you use the Store as a Consumer.

  1. Subject to the provisions of Chapter I, point (a), the following shall apply 7, these Regulations, the Consumer may withdraw from the contract without giving any reason, making, within 14 days from the date of delivery of the product to him appropriate statement in any form. To meet the above deadline, it is sufficient to send the declaration before its expiry to the Seller's mailing address: sklep@pafen.pl, Luksembourg 14, 66-620 Gubin, email address: sklep@pafen.pl.
  2. The consumer wishes to exercise his right to withdraw from the contract by returning the goods in accordance with the procedures set out in the first sentence of this chapter.
  3. In the event of withdrawal from a distance contract, the contract shall be deemed not to have been concluded. What the parties have provided is returned unchanged. The return shall be made immediately, not later than within 14 days. The purchased goods must be returned to the following address: F.H.U.U. PAFEN PIOTR HAMADA, ul. Luksembourg 14, 66-620 Gubin.
  4. The direct costs of returning the goods in connection with the exercise of the right shall be borne by the consumer, unless the shop has agreed to bear them or has not informed the consumer of his right to withdraw from the contract.
  5. In case of Customer's withdrawal from the contract, the Shop will refund the price of the product within 14 days from the date of receipt of the Consumer's statement. The return shall be made to the bank account indicated by the Consumer. Shop issues a written confirmation of the return of the benefit.
  6. The consumer is obliged to return the goods no later than 14 days from the day on which he withdrew from the contract, unless the trader has offered to collect the goods himself. The return of the goods before the expiry of the period is sufficient to comply with the time limit.
  7. Refer to the Store's website for a statement of withdrawal and e-mail confirmation of the order.
  8. The right of withdrawal from a distance contract shall not apply to the consumer in the case of services with the characteristics specified by the consumer in the order placed by him or closely related to his person;
    • The services which are the object of the contract are the goods delivered in sealed packaging which cannot be returned after opening the packaging for health or hygiene reasons if the packaging is opened after delivery;
    • services which are the object of performance are goods which, after delivery, due to their inherent nature, are inseparably connected with other goods;
    • services that are clearly tailored to the individual needs of the consumer.

 

X. Consumer's right to a warranty

  1. Products offered in the Shop are subject to 24 months of liability of the seller for non-conformity of goods with the contract. It is presumed that if the Consumer has notified the Seller of the warranty within 12 months from the delivery of the product, the defect in the product already existed at the time of its release.
  2. A complaint based on the seller's liability for non-compliance of the goods with the contract should be submitted, among others, to the following address

  3. The complaint should include a detailed description of the type of non-compliance, the date of its occurrence, the Consumer's request, order number and contact details, which will facilitate the complaint procedure.
  4. The shop shall consider the complaint immediately and in the most efficient way within 14 days of receipt of the complaint sent by the customer.
  5. In the absence of information on the manner of examining the complaint, within the time limit specified in paragraph 4, the complaint is considered to be resolved in favor of the Customer.
  6. In case of a justified complaint, the Customer may demand that the product be brought into conformity with the contract, repair or replacement of the product with a new one free of charge, reduce the price or there is a possibility to withdraw from the contract. The customer's return shop shall be informed of the price at which the entire transaction was made.
  7. The response to the complaint is sent to the e-mail address and correspondence address provided by the Customer.
  8. The shop issues a written confirmation of the return of the benefit.
  9. A sample Complaint Form can be found on the order page and is attached to the e-mail when the order is approved.

 

XI. Principles of processing personal data of buyers

  1. Detailed rules for the processing of Buyer's personal data are set out in the Privacy Policy, which constitutes Appendix No. 2 to these Terms and Conditions.

 

XII. Other

  1. The Regulations are available at: www.pafen.pl
  2. The customer has the opportunity to read, download the content of the regulations on his device and print out the document.
  3. Any disputes arising under these Terms and Conditions or agreements on sale shall be settled amicably or by a competent court of law.
  4. If the buyer is an Entrepreneur, any disputes arising under the Regulations or contract of sale shall be resolved by an arbitration court or a common court having jurisdiction over the Internet Shop's registered office.
  5. If the buyer is an Entrepreneur, the liability of the Online Shop under the warranty is excluded.
  6. The consumer has the opportunity to use out-of-court complaint and redress procedures. The consumer may make use of an amicable settlement by electronic means, e.g. by means of the EU ODR Internet platform at the following address http://ec.europa.eu/consumers/odr/
