Information concerning the exercise of the right of withdrawal.

I. Right of withdrawal

By purchasing as Consumers (natural persons performing activities with an entrepreneur not related to its business or professional activity) you have the right to withdraw from the sales contract within 14 days without giving any reason.

The period for withdrawal from the contract expires after 14 days from the day:

  • on which you acquired the goods or a third party other than the carrier and indicated by you acquired the goods, i.e. from the date on which you took delivery of the goods.

In order to exercise your right of withdrawal, you must inform us of the following

its decision to withdraw from this Agreement by means of an unequivocal declaration.

In order to respect the withdrawal period, it is sufficient for you to send the information concerning the exercise of your right of withdrawal before the expiry of the withdrawal period.

 

II. Effects of withdrawal from the contract

In the event of withdrawal from this contract, we shall reimburse you for all payments received from you, including the costs of delivery of the goods (except for additional costs incurred as a result of your choice of delivery method other than the cheapest usual delivery method offered by us), without delay and in any event no later than 14 days after the date on which we were informed of your decision to withdraw from this contract.We will effect a refund using the same methods of payment as you used for the original transaction, unless you have expressly agreed otherwise; in any event, we may withhold any fees from the refund until we have received the item or until we have received proof of its return, whichever is the earlier.

  • by post to the address: F.H.U. PAFEN PIOTR HAMANDA, ul. Luksemburg 14, 66-620 Gubin, immediately and in any event no later than 14 days after the date on which you informed us of your withdrawal from this contract.

The deadline is met if you send the item back before the 14-day deadline has expired.

You will have to pay the direct cost of returning the goods.

You are only liable for any reduction in the value of the item resulting from its use in a manner other than that necessary to establish the nature, characteristics and functioning of the item.

It is not possible to exercise the right of withdrawal in the event of a breach of contract:

  • provision of services where the trader has performed the service in full with the express consent of the consumer, who has been informed before the performance begins, that he will lose his right of withdrawal after the trader has performed the service;
  • in which the object of the service is an unprocessed item, manufactured to the consumer's specifications or to meet individual needs, in which the object of the service is a item that is liable to deteriorate rapidly or has a short shelf life;
  • in which the object of performance is the item delivered in sealed packaging, which cannot be returned after opening the packaging for health or hygiene reasons if the packaging is opened after delivery;

 

Information on the exercise of warranty rights.

I. Warranty rights.

If you make a purchase in the Shop as a Consumer (i.e. natural persons performing an activity with an entrepreneur not related to its business or professional activity.) You are entitled to a warranty, which means that as a seller I am responsible for the non-conformity of the goods with the contract.

Warranty rights EXCEPTED to the Entrepreneur.

The basis for the warranty is the appearance in the sold product:

  1. A physical defect that is claimed to be a non-conformity of the product with the contract. It happens in particular when the item:
    • does not have the property that a product of this kind should have
    • does not have the characteristics for which the consumer has been provided by the seller or by advertising
    • is unsuitable for the purpose for which the buyer informed the seller at the time of the conclusion of the contract, unless the trader has objected to such use
    • was issued to the buyer in an incomplete condition
  2. A legal disadvantage is that the goods purchased by the consumer may be the same as the goods purchased by the consumer:
    • is owned by a third party;
    • is encumbered with the rights of a third party;
    • is characterised by limitations in its use or disposal as a result of a decision or decision of a competent authority;

The period for exercising the right of warranty expires 24 months after the date on which you acquired the goods or a third party other than the carrier and indicated by you acquired the goods, i.e. the date on which you received the consignment of goods.

In this case, for the duration of the liability of the seller, it shall be presumed that the defect found or its cause already existed at the time of the sale.

If a defect is discovered at a later date, i.e. between 12 and 24 months from the date of delivery of the goods, the consumer shall demonstrate that the defect existed at the time of purchase.

If the shop conceals a defect in the sold product, you can take a warranty even after the expiry of the above deadlines.

In the event of a defect, you have the opportunity to lodge a warranty claim with our Store and request one of the four actions:

  • the exchange of goods for a new one;
  • to repair the goods;
  • the price reduction, specifying the amount by which the price is to be reduced;
  • withdraw from the contract if the defect is material.

In order to exercise the right of warranty, it is necessary to provide information in any form, including a precise description of the defect, through:

As a dealer, I am obliged to respond to your requests within 14 days. If I do not reply within this period, the complaint will be deemed valid. The reply to the complaint will be sent to the e-mail address provided by you.

In case of a refund or price increase, the Store issues a written confirmation of the refund.
